Palo Alto offers an instant permit for heat pump heating and cooling at detached single-family homes, duplexes and ADUs. A C-20 licensed contractor can file it for up to three systems, with units rated under 65 dBA, not on the roof, and not placed between the street and the home or visible from the public right of way. The permit calculates a property line setback that the inspector verifies.

What qualifies

According to the City of Palo Alto, the instant permit covers new, retrofit or replacement heat pump space conditioning systems when:

  • The property is a detached single-family home, duplex or ADU
  • The work is done by a licensed contractor with a C-20 (HVAC) classification
  • The scope is up to three systems, including furnace or air handler installation and associated ductwork
  • Each heat pump has a noise rating under 65 dBA
  • Equipment is not on the roof, not between the street and the home, and not in view from the public right of way

Projects that don’t meet these criteria go through the City’s standard Building Pre-Application process instead.

Setbacks and noise

The instant permit calculates a minimum setback from the nearest property line for the outdoor equipment, and the inspector verifies it. Noise is calculated for clusters of systems within 10 feet of each other. Systems more than 10 feet apart need separate instant permits.

This is why unit selection and placement are linked. A quieter unit can often sit closer to the property line, which matters a lot on narrow lots like those in College Terrace.

What your contractor needs to submit

  • A completed Residential Load Calculation worksheet
  • Equipment specifications: make, model, capacity, voltage, amperage, system type and noise level
  • A CF1R energy compliance form completed by a HERS rater

They’ll also need project valuation, the number and location of systems, distances to existing noise-producing equipment, whether ducts are being replaced, and the condensate drain location.

Why it matters to you

“Instant” means no plan review wait. Permit issuance doesn’t require staff review, so your project can be scheduled as soon as equipment is ready. The inspection still happens after installation, so placement and setbacks have to be right the first time.

Pairing with rebates

The instant permit and the CPAU Heat Pump HVAC rebate work well together: the permit gets you started quickly, and the final inspection starts your 90-day rebate application window. See our CPAU rebate guide.

How ComfortFlow HVAC Palo Alto prepares an instant permit

  1. Room-by-room load calculation for heating and cooling
  2. Equipment selection with sound rating under 65 dBA
  3. Placement plan that meets the calculated property line setback
  4. CF1R energy compliance form from a HERS rater
  5. Submission, installation and final inspection scheduling

The final inspection also starts the 90-day window for your CPAU rebate application, so we schedule it promptly once the system is commissioned.

GOOD TO KNOW

Quick answers.

The short version of this guide, from the ComfortFlow HVAC Palo Alto team.

Can I pull the instant permit myself?

The City describes the instant permit as available to licensed contractors with a C-20 classification. The process requires documents most homeowners do not have: a residential load calculation, equipment specifications including the sound rating, and a CF1R energy compliance form completed by a HERS rater. ComfortFlow HVAC Palo Alto prepares and submits these as part of every qualifying heat pump installation.

Can the outdoor unit go in my front yard?

Not under the instant permit. Units can’t be placed between the street and the home or in view from the public right of way. Side and rear yards are the usual locations. The permit also calculates a minimum setback from the nearest property line based on the unit’s sound rating, and the inspector verifies it. On narrow lots, choosing a quieter unit can make the difference between a spot that qualifies and one that does not.

What if my project doesn’t qualify?

Projects outside the criteria use the City’s standard Building Pre-Application process. Common reasons a project falls outside the instant permit include more than three systems, units that must go on the roof, or placements visible from the street. The standard path involves plan review and takes longer, but it allows the City to consider special cases. We tell you up front which path your project needs.

Does the instant permit cover ductwork?

Yes, associated ductwork and furnace or air handler installation are included for up to three systems. That makes it practical to fix leaky or undersized ducts during the heat pump installation, when access is easiest. Heat pumps move more air at lower temperatures than gas furnaces, so duct improvements often make a noticeable difference in comfort. We test airflow before recommending any duct changes.
